Terms and conditions of sale
These General Terms and Conditions of Sale govern the sale of products marketed by Red Sound Srl (hereinafter RED SOUND) with registered office at C/da Rubino, snc, Strada Provinciale 14 – Km 3,5 – 95032, Belpasso, CT.
All distance purchase contracts, concluded online through rslive.it and according to the procedures indicated therein, between the seller and the Customer, will be governed by these General Conditions, which are accepted by the Customer.
Any derogating clauses as well as any special supply conditions must be expressly agreed in writing. Any behavior, even repeated, of one of the two parties that does not correspond to one or more of these conditions will in no way prejudice the right of the other party to request the application of the same at any time.
The selling company reserves the right to make, unilaterally and at any time, changes to these General Conditions, which will be effective from the moment of publication on the website indicated above and will refer to sales made from that moment onwards.
Production times
If not available, the merchandise enters production immediately after payment confirmation. The production time may vary according to the type of product ordered, indicatively from 10 to 15 working days. To receive the goods in the shortest possible time, the most important thing to do is to confirm the payment by sending us a copy of the receipt.
RED SOUND undertakes to carry out production in the shortest possible time and, in any case, within 15 (fifteen) working days starting from the day after receipt of payment. Otherwise, the order will be to the customer. However, no responsibility can be attributed to RED SOUND in case of delay in processing the order or in delivering the ordered goods.
Delivery times
The ordered product will be delivered to the Customer via our affiliated courier. The express courier delivers within 48 hours of shipping. For Sicily, delivery is within 24 hours. Problems and delays by national couriers are not attributable to us. Shipping is a service offered entrusted to third parties. The goods always travel at the risk and peril of the sender. Delivery times of ordered products are purely indicative; they may be subject to variations due to traffic conditions and viability in general, by act of Authority or due to force majeure (carriers' strikes, etc.), as well as for otherwise unforeseeable events such as earthquakes, floods, fires, explosions and similar. In such cases, RED SOUND does not assume any responsibility for the consequent disservices, nor for damages and/or losses and/or costs incurred as a result of the non-execution of the contract for the above mentioned causes. With reference to the delivery of goods via courier, the obligation to deliver the product by RED SOUND is considered regularly fulfilled at the moment in which the ordered goods are delivered to the courier. Therefore, any delays and/or inconveniences or similar events in the delivery of the package, shall be attributed solely to the company that manages the shipment. In such cases, the Customer undertakes not to make any claim for compensation against RED SOUND.
Complaints
At the time of delivery of the goods, the Customer is required to check: – that the number of packages being delivered corresponds to what is indicated on the invoice; – that the packaging is intact, not damaged, nor wet or, in any case, altered; – the goods also travel with packaging made directly by the manufacturer. Any external damage or the mismatch of the number of packages or indications, must be immediately disputed to the courier who makes the delivery, by placing the writing "ACCEPTED WITH RESERVATION" on the courier's delivery receipt indicating "THE REASON" for such reservation (Ex. I accept with reservation damaged package) and, furthermore, confirmed, within 8 days by registered mail with return receipt TO THE COURIER, whose address is specified on the accompanying document. Once the courier's document has been signed, the Customer cannot raise any dispute about the external characteristics of what has been delivered. Acceptance of goods without reservation precludes the possibility of subsequent complaints for any shortages or damage due to transport. Any hidden damage must be reported via email within 5 working days. It is essential to attach photographic documentation proving the damage. For the cases mentioned above, RED SOUND must be considered exempt from any liability for loss or damage of the goods from the moment the same is delivered without reservation to the carrier for transport. The Customer, from the moment of receiving damaged goods or requesting their redelivery to the carrier, has direct and exclusive action against the carrier itself.
Warranty
RED SOUND guarantees the quality of its products.
The warranty becomes void, in addition to everything provided for by law, in case of tampering or interventions not authorized by RED SOUND.
In any case, the client forfeits the warranty if he has omitted the relative report pursuant to art. 1495 1st paragraph of the Civil Code.
In addition to all the reasons already indicated, the warranty will not apply in case:
– in which the failure or malfunction has been caused by negligence, tampering, incorrect or improper use;
– of damages and accidents not dependent on RED SOUND or deriving from fortuitous causes or force majeure.
In the event that, for any reason, it is not possible to return a product under warranty to its Customer (restored or replaced), RED SOUND may proceed at its discretion to reimburse the lower value between the market value, at the time of the request, and the invoiced one; or to its replacement with a product of equal or superior characteristics. No damage can be claimed from RED SOUND for any delays in carrying out repairs or replacements of products under warranty. In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer complete in all its parts (including any documentation and accessory equipment: manuals, etc...) and carefully packaged.
Right of withdrawal
The Customer, pursuant to art. 64 of Legislative Decree no. 206/05, has the right to withdraw from the purchase contract for any reason, without any penalty and subject to what is indicated in the following point 3. The right of withdrawal may be exercised by the Customer within 10 (ten) working days starting from the receipt of the product by the Customer, by sending a registered letter with acknowledgment of receipt, anticipated via e-mail to the address info@rslive.it in which it will also be necessary to indicate the bank details necessary to return the sums paid. Upon receipt of the communication, RED SOUND will send an e-mail to the Customer indicating the methods for collecting the goods. The right of withdrawal is subject to the following mandatory conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories) the purchased good must be intact and returned complete in all its parts and any documentation and accessory equipment: manuals, etc...) the good subject to exercise of the right of withdrawal must be returned in normal state of conservation, as it has been kept and possibly used with the use of normal diligence: therefore, products used that show signs of damage or negligence and that consequently can no longer be considered intact will not be accepted the shipping costs related to the return of the good are borne by the Customer.
The shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the Customer in case of damage to the good during transport, RED SOUND will notify the Customer of the event (within 5 working days from receipt of the good in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the good (if insured); in this eventuality, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request RED SOUND does not respond in any way for damage or theft/loss of goods returned with uninsured shipments RED SOUND will reimburse the Customer the amount already paid (except for delivery costs), in the shortest possible time and in any case within 30 days from the date of receipt of the withdrawal communication, upon receipt of the goods subject to withdrawal, through a reversal procedure of the amount charged by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN Code of the invoice holder) The right of withdrawal lapses completely, due to the lack of the essential condition of integrity of the good (packaging and/or its content), in cases where it is ascertained: the lack of the external packaging and/or the original internal packaging the absence of integral elements of the product (accessories, manuals, parts, ...) or anomalies to the product itself the damage of the product a state of dirtiness of the product due to its use, which has compromised its integrity. The expenses and risks of transport for the return are entirely borne by the Customer.
The return of non-intact, deteriorated products or products without original accessories and equipment will not be accepted by RED SOUND and will be returned to the sender with an increase in transport costs. In the case of forfeiture of the right of withdrawal, RED SOUND will make the product or products available to the customer for their collection.
